DATA BACKUPS. Atlantis Hosting will do everything in its power to ensure that client data is kept safe. However, data safety will ultimately rest with the client. Clients should take necessary steps to ensure that a current backup of all information is available. Client backups would be needed in the event that backups performed by Atlantis Hosting are unavailable.
UPTIME GUARANTEE. Atlantis Hosting guarantees that your site will be online at least 99.9% of any given calendar month. Proof of failure must be made with trace routes and ping tests conducted in intervals of not more than five minutes. Clients proving failure of this clause will receive a credit for one month of free service. This guarantee does not cover downtime due to your own actions or the actions of your clients. This guarantee also does not apply for downtime due to pre-announced, scheduled maintenance. It is agreed that this shall be the only liability that we have for downtime. Atlantis Hosting will not be responsible for lost revenues or other funds due to system downtime.
MONEY BACK GUARANTEE. We at Atlantis Hosting wish for you to be happy with the service that we are providing you. If at any time in the first 30 days after opening your hosting account you decide that you are unhappy with our services, simply enter your control panel and then click the Money Back link.
ACCOUNT CANCELLATION. Users wishing to cancel service within the first 30 days of hosting can simply enter the control panel and click the Money Back link. After the initial 30 day period, users must follow this process to cancel their accounts:
(i) Client must send an email containing the following information to sales@atlantishost.com:
(a) Full Billing Name
(b) Account Username
(c) Account Password
(d) Domain Name(s)
(e) Billing Address
(f) Billing Phone Number
(ii) When we receive this email, we will check the information against our records. If the information matches, we will send an email back to the client requesting confirmation. This is meant for added security to our clients.
(iii) Client must reply to the confirmation email within three days. If this deadline is not met, the process must be repeated from the beginning.
(iv) Atlantis Hosting reserves the right to require that a fax be sent with complete, valid photo identification of the client.
- The cancellation of accounts may take up to 72 hours. Clients should account for this in their timing of cancellation requests.
- Clients will be responsible for saving any information from their server accounts. All information will be deleted and will become unrecoverable once the account has been cancelled.
- Refunds will be issued within 30 days for any full, unused months that were previously paid for. If any portion of a month has been used, no refund will be issued. Accounts terminated due to policy issues will not receive a refund.
- No refunds will be issued for setup fees.
- No refunds will be issued for domain names.
ACCEPTABLE PAYMENT METHODS
CREDIT CARDS. Payment by credit cards is highly preferred. We currently accept Visa, Mastercard, Discover, Diner's Club, Carte Blanche, and American Express.
PAYPAL. Users can transfer funds to us through PayPal.
CHECK PAYMENTS will be accepted as payment only if they are payable in United States Dollars. Atlantis Hosting reserves the right to freeze account setup until payment has cleared our bank. Checks are not accepted for domain name registrations.
AUTOMATIC CONTRACT RENEWAL. All hosting contracts will automatically renew
after expiration unless we have received a cancellation request at least
72 hours prior to expiration. Atlantis Hosting may renew domain names up
to 60 days prior to expiration.
PAST DUE PAYMENTS - All accounts must be kept current. If payment is not received by the due date listed on your invoice you will not be able to add additional services to your account. Also, some current services may become unusable.
ACCOUNT SUSPENSION may occur for past due accounts, violations of the Terms of Service, or questionable activity. Accounts with payments fifteen (15) or more days past due will be suspended. Suspension will render your account useless by preventing access to FTP, E-Mail, and Web Services. During this time, any visitors to your web site will be presented with a screen stating that the account has been suspended or is unavailable. Atlantis Hosting shall not be held liable for any revenue lost due to account suspensions.
ACCOUNT TERMINATION may occur if your account has been suspended and the issues leading to the suspension have not been corrected. Accounts with payments of 25 or more days overdue will be removed from our systems. Atlantis Hosting will not be responsible for any data lost due to non-payment termination. Nor will we be held liable for any lost revenue due to downtime caused by non-payment termination.
NON PAYMENT DISCLOSURE. Atlantis Hosting reserves the right to publish information regarding accounts terminated due to non-payment issues. This information, if published, will become available for other Internet hosting companies to guard themselves against similar behavior.
ACCEPTABLE CONTENT
All services provided may be used for lawful purposes only. Transmission, storage, or presentation of any information, data, or material in violation of any United States Federal, State, or City law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret or other statute. The subscriber agrees to indemnify and hold us harmless from any claims resulting from the use of the service that damages the subscriber or any other party. By using our services, subscribers agree that we may monitor accounts for illegal activity. Any suspicious activity may be reported to the proper authorities. Pornography and sex-related merchandising is prohibited on all of our servers. This includes sites that may infer sexual content, or links to adult content elsewhere. We will be the sole arbiter in determining violations of this provision. Sites that promote any illegal activity or present content that may be damaging to our servers or any other server on the Internet are also prohibited. Also prohibited are links to such materials. Examples of unacceptable content/links: pirated software, hacker programs or archives, and warez sites. We will be the sole arbiter as to what constitutes a violation of this provision.
ELECTRONIC MAIL USAGE
PROHIBITED ACTIVITY. Spamming, the sending of unsolicited email, from our server or using an email address or domain that is maintained on our machines as reference is STRICTLY prohibited. We will be the sole arbiter as to what constitutes a violation of this provision. Atlantis Hosting may, at its sole discretion, terminate your account without warning if your conduct violates these terms.
MAIL LIMITS. Atlantis Hosting does not limit the number of electronic mail messages sent from your account. However, the storage space associated with each electronic mail account is limited to the amount of space described on our Hosting Packages page of our website. This page will also list the maximum number of mailboxes, autoresponders, mailing lists, aliases, and forwarders allowed for your account without an extra fee.
SYSTEM NOTIFICATIONS - Important notices will be sent via electronic mail to the address listed for your account. This address can be viewed or changed by clicking the Contact Info or Update Personal Information button in your account's Control Panel. It is the responsibility of the client to keep this address up-to-date.
BACKGROUND RUNNING PROGRAMS - We may allow programs to run continually in the background. These are considered on a case-by-case basis and an extra charge will be incurred based on system resources used and operational maintenance needed.
REFUSAL OF SERVICE - We reserve the right to refuse, cancel, or suspend service to any account at our sole discretion. Failure to follow any term or condition will be grounds for immediate account deactivation.
LICENSE GRANT. Subject to the provisions contained herein and payment of applicable fees, Atlantis Hosting hereby grants to you a non-exclusive, nontransferable, license
to use its accompanying proprietary software application products offered on the Atlantis Hosting web site ("Software",) for your own use. Such Software is protected
by the laws of the United States and international treaties.
RESTRICTED USE. All rights not expressly granted herein are retained by Atlantis Hosting and its licensors. Except as stated above, this Agreement does not grant the Customer any intellectual property rights in the Software. Customer shall not rent, lease, transfer or sublicense the Software. Customer shall not under any circumstances nor shall Customer permit a third party to
(i) decompile, disassemble, reverse engineer or otherwise attempt to reconstruct or discover the source code of the Software or
(ii) prepare derivative of the Software or
(iii) remove any product identification, Atlantis Hosting, trademark or other notice from the Software. Any such copy made by you shall be subject to this Agreement and shall contain all of Atlantis Hosting's notices regarding Atlantis Hosting's, trademarks and other proprietary rights as contained in the Software originally provided to you.
TITLE. The Software's organization, structure, sequence, logic, and source code are valuable to the Company. Any and all title, ownership rights, and intellectual property rights in and to the Software and Documentation shall remain at any and all times in Atlantis Hosting and/or its suppliers. Title, ownership rights, and intellectual property rights in and to the content accessed through the Software is the property of the applicable content owner and may be protected by applicable Atlantis Hosting or other law. This License does not give Customer any rights to such content.
Atlantis Hosting reserves the right to revise or replace this policy at any time without prior notice.
